Pursuant to the Law on Organization of People’s Councils and People’s Committees dated November 26, 2003

Pursuant to the Law on Minerals No. 60/2010/QH12 dated November 17, 2010; Decree No. 15/2012/NĐ-CP dated March 9, 2012 of the Government detailing the implementation of a number of articles of the Law on Minerals;

Pursuant to the Circular No. 16/2012/TT-BTNMT dated November 29, 2012 of the Ministry of Natural Resources and Environment, providing for mineral exploration projects, mineral mine closures and mineral activity report forms, sample documents in the application for licensing mineral activities, the application for approval of mineral reserves, the application for closure of the mineral mine;

Pursuant to the Decision No. 1270/QĐ-BTNMT dated April 30, 2014 of the Ministry of Natural Resources and Environment on approving the results of zoning off areas with small and odd scattered minerals, phase 2;

Considering the application dated August 10, 2014 of Kim Phát Mineral Co., Ltd. (attached to the dossier submitted at the Department of Natural Resources and Environment) for a license to explore iron ore minerals in Đầm village, Lương Nội commune, Bá Thước District, Thanh Hóa Province;

At the request of the Director of Thanh Hóa Department of Natural Resources and Environment in Report No. 1070/STNMT-TNKS dated December 1, 2014,

DECISION:

Article 1. Permit Kim Phát Mineral Co., Ltd. to explore iron ore minerals in Đầm village, Lương Nội commune, Bá Thước district, Thanh Hóa province;

• The exploration area is 25.4 hectares limited by corner points 1, 2, 3, 4, 5 and 6 with coordinates specified on the attached mineral exploration area map (Appendix 2);
• Exploration term: 05 months from the date of signing the license
• Exploration volume is mainly under Appendix 3 to this License;
• Exploration expenses: By the capital source of the unit (unit price applied according to current regulations of the State);
• License fee: 4,000,000 VND (Four million VND)

Article 2. Kim Phat Mineral Co., Ltd. is responsible for:

1. Pay mineral exploration license fees and related fees according to current regulations; Payment for the use of data and information on results of mineral investigation and exploration of the State;
2. Conduct iron ore exploration according to the method and volume specified in -…- ensuring labor safety, environmental protection, and safety of explosives (in case of mineral exploration using explosive materials); collect and synthesize fully and accurately documents and survey results; inspect and take responsibility for the volume, quality and truthfulness of actual construction documents; fully preserve and store original documents, relevant actual documents and geological and mineral specimens according to current regulations;
3. Protection of mineral resources; strictly prohibit all mining activities in the process of exploration; if other minerals are detected, they must promptly report in writing to the People’s Committee for handling according to regulations;
4. Conduct analysis of samples at facilities meeting VILAS, LAS-XD standards; clarify the quality, mineral reserves for the purpose of use. Before taking technology samples, the volume, location, time and method of sampling must be registered at the Department of Natural Resources and Environment for field inspection and implementation supervision;
5. To strictly comply with the periodical reporting regime in accordance with current regulations;
6. Submit for appraisal and approval the report on exploration results at the Mineral Reserve Evaluation Council of the Provincial People’s Committee and submit the report in accordance with the law on minerals; submit reports to the Geological Archives according to current regulations.

Article 3. This license takes effect from the date of signing.

Mineral exploration activities under this license, Kim Phap Mineral Co., Ltd. are only allowed to carry out after notifying the exploration program and volume to the Department of Natural Resources and Environment and local authorities for coordination. manage, inspect and determine specifically the area, coordinates and boundaries of the exploration area for the Department of Natural Resources and Environment and local authorities to coordinate in management, inspection and specific identification of the area, coordinates, landmarks of the exploration area in the field.

Conducted inspection and acceptance test of fire protection system for the project: 3,000 kg of industrial explosives warehouse with accessories of Kim Phat Minerals Co., Ltd in Luong Noi commune, Ba Thuoc district, Thanh Hoa province.

The status and test results are as follows:

1. Dossier for inspection and acceptance:

• A copy of the certificate of fire prevention and fighting approval;
• A copy of the certificate of inspection of installed fire protection equipment;
• Report of acceptance of fire protection system and related items, construction completion documents;
• Report of testing the grounding resistance of the grounding system;
• Documents and procedures to guide the operation and maintenance of fire protection equipment

2. Inspection and practical testing of fire protection systems.

• Scale of the project: Warehouse of industrial explosives with a reserve of 3,000 kg with accessories.
• Security house: Constructed and installed.
• Construction fire resistance level: Construction according to design.
• Escape route: Construction according to design
• Lightning protection system: Construction according to design.
• Fire fighting system:
  • Fire water tank: V = 1m³.
  • Fire sand tank: V = 1m³.
  • Fire extinguisher: 04 MFZL4-ABC; 02 W6 fire extinguishers.

3. Conclusions and requests.

3.1. Request

It is recommended that the investor compile a management file on fire prevention and fighting work according to regulations, develop and organize practice of fire fighting plans, organize training on fire prevention and fighting activities for officials and workers. During the operation, it is necessary to ensure the safety conditions on fire prevention and fighting for industrial explosives warehouses according to regulations.

The content of the above recommendations requires the investor to strictly implement.

3.2 Conclusion:

At the time of inspection, the items related to fire prevention and fighting have been constructed and installed at the construction site in accordance with the design.

The report were completed at 10:00 a.m. on the same day, consisting of 02 pages made into 02 copies, each interested party sent 01 copy, read it for everyone to hear and agreed.

Implementation of License No. 325/GP-UBND dated August 13, 2015 of Thanh Hóa Provincial People’s Committee allowing Kim Phát Minerals Co., Ltd. to mine minerals and lease land at iron ore mines in Đầm village, commune Lương Nội, Bá Thước district.

Today, September 29, 2015, Thanh Hoa Department of Natural Resources and Environment in collaboration with Ba Thuoc District People’s Committee, Luong Noi Commune People’s Committee and Kim Phat Minerals Co., Ltd assign the mine to a field unit.
